SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or alteration of your data
• Any third-party conduct or content on the Services
• Any other matter relating to the Services

11. Indemnification

You agree to indemnify, defend, and hold harmless Digital Nomads s.r.o. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you through the Services or by other means. Your continued use of the Services after such notification constitutes your acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Ostrava, Czech Republic.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digital Nomads s.r.o. regarding the use of the Services and supersede any prior agreements.

If you access our Services through an application downloaded from the Apple App Store, the following additional terms apply:

• Apple has no obligation to provide maintenance or support for the app
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the app
• Apple is a third-party beneficiary of these Terms with the right to enforce them
